En sus considerando, el decreto presidencial hace referencia que bajo una nueva Constituci\u00f3n, una nueva legislaci\u00f3n en materia de seguridad social y la integraci\u00f3n al Tratado de Libre Comercio entre Estados Unidos y Centroam\u00e9rica (DR-CAFTA), se requiere reformar el C\u00f3digo de Trabajo. En adici\u00f3n a ello, un 58.7% del empleo est\u00e1 en la informalidad; es decir, casi 6 de cada 10 empleados opera en la informalidad, con menores ingresos y escasos beneficios laborales como entrenamiento y la seguridad social. De los 121,000 empleos que se generaron en 2017, el 85% se crearon en la informalidad y se destruyeron casi 26,000 empleos en el sector privado. S\u00f3lo con la generaci\u00f3n de unos 44,000 empleos p\u00fablicos se pudo apreciar un incremento de unos 18,000 empleos en la formalidad. Como sabemos, las empresas asumen costos adicionales al salario por cada empleo que generan. En este sentido, estimamos que el costo laboral no-salarial para las empresas de generar un puesto de trabajo formal es de 54% del salario que pagan a los trabajadores, lo que penaliza el empleo productivo en la legalidad. Si en un momento determinado una empresa enfrenta problemas en cuanto a sus operaciones y\/o su desempe\u00f1o, el costo de reestructurar la empresa es muy elevado. En este sentido, los representantes sindicales indican que la cesant\u00eda laboral actual representa una conquista laboral que no puede tocarse, con posiciones muy cerradas. En el contexto econ\u00f3mico actual, la pregunta ser\u00eda: \u00bfa qui\u00e9nes beneficia la modalidad de cesant\u00eda laboral como est\u00e1 en la legislaci\u00f3n actual? Con la destrucci\u00f3n de 26,000 empleos productivos privados formales y la generaci\u00f3n de empleos principalmente en la informalidad, es una pregunta dif\u00edcil de responder. Sin embargo, los empleados actuales se perjudican porque pudieron tener un salario mayor si este costo se limitara. A quienes mas perjudica el sistema actual con altos costos laborales no-salariales son a las personas desempleadas y los 6 de cada 10 dominicanos que laboran en la informalidad<a id=\"_ftnref2\" style=\"color: #065991; padding: 0px; margin: 0px; font: inherit; vertical-align: baseline; border: 0px initial initial;\" title=\"\" href=\"http:\/\/crees.org.do\/es\/art%C3%ADculo\/reformas-la-cesant%C3%ADa-beneficia-la-creaci%C3%B3n-de-empleos-formales#_ftn2\" name=\"_ftnref2\">[2]<\/a>. Con la cesant\u00eda, entonces, se busca evitar una disminuci\u00f3n en la calidad de vida de los trabajadores cesantes durante el per\u00edodo de b\u00fasqueda de otro puesto de trabajo. En adici\u00f3n a su objetivo principal, el concepto de la cesant\u00eda laboral en la Rep\u00fablica Dominicana era proveer un mecanismo para el retiro por vejez de los trabajadores, lo que ya no se justifica. Unos porque no encuentran empleos, otros porque solo encuentran puestos de trabajo en la informalidad y los que consiguen trabajo en la formalidad porque sus salarios ser\u00e1n menores del potencial que pudiesen obtener sin las distorsiones mencionadas. La Rep\u00fablica Dominicana requiere de reformas importantes al C\u00f3digo de Trabajo para corregir las distorsiones que limitan la generaci\u00f3n de m\u00e1s y mejores empleos en la formalidad. Seg\u00fan la END, esta modificaci\u00f3n debi\u00f3 entrar en vigencia \u201cen un plazo no mayor de dos (2) a\u00f1os\u201d luego de promulgada esa ley org\u00e1nica. En muchos pa\u00edses existen seguros de desempleo p\u00fablicos, donde se transfieren recursos a las personas que pierden su empleo. Este tipo de esquemas son subsidios que provienen de los recursos de los contribuyentes a trav\u00e9s de pago de impuestos. Adem\u00e1s de que son esquemas costosos y que se pueden prestar a la manipulaci\u00f3n pol\u00edtica y la corrupci\u00f3n, estos mecanismos no crean los incentivos correctos para hacer el mejor uso de los recursos ni para promover el reentrenamiento de los trabajadores ni la b\u00fasqueda r\u00e1pida de nuevos puestos de trabajo.
